DUI / DWI & TRAFFIC OFFENSES

Driving Under the Influence of Alcohol

If you are charged with a DUI, immediate action is necessary in order for you to keep your license and to protect your rights. In Delaware, you have 15 days to request a DMV Hearing in order to keep your license pending trial. This is a step separate from the criminal process and is one that is often overlooked. DUI law is complicated and ever changing. Alcohol is a legal substance; however, even moderate consumption can be illegal when driving under the influence. The Law Office of Richard Zemble DUI / DWI experience

During the last 8 years I have had extensive experience both prosecuting and defending DUI’s in Delaware and can help you to get the best possible outcome. Although well trained, the police do not always follow the book and you need an attorney with sufficient experience to review thoroughly all the actions the police officers take at the time of your arrest with the end in mind of exposing their errors. For example, there may not have been probable cause for your arrest or there may have been problems with the intoxilizer reading.
Delaware Road Blocks
Here in Delaware the police frequently set up road blocks to trap drivers who have had a minimal number of drinks. There are steps an experienced attorney can take to help you if you are arrested for drunk driving in a road block. Remain calm and call me at 302-377-4471 for a free initial consultation.
Results of DUI / DWI Convictions
DUI convictions result in a loss of license and possible jail time. A first time DUI arrest can seriously affect your life and your life style. A first time drunk driving conviction can result in a large fine, increased insurance premiums, a loss of your drivers license and occasionally a jail sentence. Drivers charged with a first DUI charge may opt to go into the First Offenders Program. If you participate in the First Offenders Program, you must agree to the ignition interlock program and pay for the installation in your car and the monitoring of the device.
There are mandatory sentences for multiple offenses of drunk driving. The 2nd offense results in a misdemeanor with a mandatory sentence of 60 days in prison. The 3rd offense is a felony with a mandatory sentence of 90 days in prison. The 4th offense is a felony with a mandatory offense of 6 months in prison.
If you are arrested for drunk driving, call me at 302-377-4471. I will make sure the police had reasonable suspicion to pull you over and probable cause to arrest you. Oftentimes a motion can be filed to suppress evidence in DUI cases. I promise to do everything I can to achieve the best possible outcome for you in your DUI arrest.

Traffic Offenses

There is a broad range of traffic offenses in the Delaware Code. Traffic violations can result in excessive fines and increases in insurance premiums. Traffic citations include:
°aggressive driving
°reckless or careless driving
°leaving the scene of an accident
°speeding tickets
°driving while suspended
°driving without insurance
°driving an unregistered vehicle
°driving without a license
°seat belt violations
°DUI / DWI and related matters
Traffic offenses can result in fines, points and a possible suspension of your license. Try to avoid getting points added to your record and try to avoid increased increased insurance rates. If DUI charges are involved, your problems are even more serious. It is imperative to hire an attorney who is familiar with traffic offenses. Whether you have a Delaware license or an out of state license, traffic offenses can have a serious impact on your driving privileges. I have prosecuted and defended traffic offenses in Justice of the Peace Courts and the Court of Common Pleas. For more information about the State of Delaware DUI / DWI code, click here for a detailed DUI code education page for you to read. (There is a DUI code education page 2.) I have also prepared a DUI common questions page with explanations. (There is a DUI common questions page 2.)Because traffic violations are common, I have listed the PennDot (Pennsylvania Department of Transportation) chart of points received from traffic violations.
